The battered woman syndrome is a theory that was applied in Anglo-Saxon law, specifically in Common Law, which is a means of defense for people who were assaulted and subsequently kill their aggressors. The objective of the research is to describe through a legal, doctrinal and scientific analysis whether or not the battered woman syndrome operates as an exclusion of unlawfulness within the crime of murder. The results allow establishing that domestic abuse can lead a woman to commit a criminal act, without having the will to do so. This behavior is defined by specialists in psychology and forensic medicine as a temporary dementia, uncommon brain disorders that significantly affect the conduct and behavior of the person.
El síndrome de la mujer maltratada es una teoría que se aplicó en el derecho anglosajón,específicamente en el Common Law, que es un medio de defensa para las personas que fueronagredidos y posteriormente asesinados por sus agresores. El objetivo de la investigación esdescribir a través de un análisis jurídico, doctrinal y científico si laEl síndrome de la mujer maltratada opera como una exclusión de la antijuricidad dentro deldelito de asesinato. Los resultados permiten establecer que el maltrato doméstico puede conducir amujer a cometer un acto delictivo, sin tener la voluntad de hacerlo. Este comportamientoes definido por especialistas en psicología y medicina forense como undemencia, trastornos cerebrales poco comunes que afectan significativamente la conducta ycomportamiento de la persona.
