    EL DERECHO CAMBIARIO, LA LETRA DE CAMBIO Y EL PROCEDIMIENTO EJECUTIVO EN EL NUEVO CODIGO ORGANICO GENERAL DE PROCESOS

    Abstract

    One aspect that I consider relevant for analysis and study, will always be the historic appearance; because through this we can remember, know and preserve the heritage policy, developed over several centuries and which has allowed to create several legal figures who are still currently. In this respect I refer to (Carnelutti, 1944), who professed: "the need for science history is infinite because to learn the law it is necessary to know the last right". Therefore, we understand that existing legal standards have its handle in the past and recognizes them as valuable and useful for the jurists of today. Otherwise, the current legislation is the result of an evolutionary process of the past; and for no reason should despise the origin, transformation and the development of commercial standards. This scientific article aims to explain the genesis of the exchange law, of a title value that is called the Bill of Exchange, and the exchange procedure in Ecuadorian legislation; their transformations throughout history and its current conception. This is an analysis of the legal rules in centuries past, looking for the most relevant and outstanding in this evolution features. Finally, this research includes evolutionary aspects of the commercial rules that govern the Ecuadorian State, to delve into the current code organic General process, issued by registry official number 506, 22 may 2015.

    Resumen

    Un aspecto que considero relevante de análisis y de estudio, será siempre el aspecto histórico; por cuanto a través de éste podemos recordar, conocer y preservar el legado normativo, desarrollado a lo largo de varios siglos y que ha permitido crear varias figuras jurídicas que aún se mantienen en la actualidad. En relación a esto, debo referirme a (Carnelutti, 1944), quien profesaba: ?La necesidad que la ciencia tiene de la historia es infinita porque para aprender el derecho vigente es menester conocer el derecho pasado?. Por tanto, se comprende que las normas jurídicas vigentes tienen su asidero en el pasado y se las reconoce como valiosas y útiles para los juristas de la actualidad. Dicho de otro modo, la normativa actual es la consecuencia de un proceso evolutivo del pasado; y por ningún motivo se debe despreciar el origen, la transformación y el desarrollo de las normas mercantiles. El presente artículo científico, pretende explicar la génesis del derecho cambiario, de un título valor denominado la letra de cambio, y el procedimiento cambiario en la legislación ecuatoriana; sus transformaciones a lo largo de la historia y su concepción actual. Por ello se realiza un análisis de las normas jurídicas en siglos pasados, buscando los rasgos más relevantes y destacados de dicha evolución. Finalmente, esta investigación recoge los aspectos evolutivos de las normas mercantiles que rigen al Estado ecuatoriano, hasta adentrarnos en el actual Código Orgánico General de Procesos, expedido mediante Registro Oficial número 506, del 22 de mayo del 2015.
